Appeals court: a shopping agent is the user's tool
The Ninth Circuit vacated Amazon's injunction against Perplexity's Comet. Contract claims are still open.
The US Court of Appeals for the Ninth Circuit vacated an injunction Amazon had won against Perplexity's Comet browser assistant. Under federal anti-hacking law, the court said, the agent is a tool and the user is the one accessing the site.
The ruling does not settle whether agents break a site's terms of service; those contract claims continue. But it shapes how responsibility for agent actions is likely to be seen.
